Request vs. NIRC prior art

When an ex parte reexamination concludes with a Notice of Intent to Issue a Reexam Certificate (NIRC), this page compares the prior art the requester relied on — the references underlying the substantial new questions of patentability, as recited in the reexam order — against the art the examiner actually discussed in the NIRC's statement of reasons. Each NIRC reference is labeled by the role it played: used to invalidate a challenged claim, or the closest art distinguished for a confirmed claim. The headline statistic is how often at least one reference from the request was operative at the NIRC.

Reference extraction and cross-document matching are performed by an AI reading the order and NIRC text; the percentages are computed from those stored lists. NIRCs that state no art-based reasons (e.g. confirmed for the reasons in the final Office action) are excluded from the percentage and reported separately.
